Islamic Ruling on a Person Who Dies Without Making up Missed Fasts
By Muslim Media Practitioners
A person who passed away while having some missed fasts to restitute should have the fasts done on his behalf, if the fast is due to a vow which he had not been able to fulfil, or a missed fast of Ramadan or a fast of personal atonement which for some reasons he had not been able to do.
The evidence for this is the Hadith narrated by Aisha, may Allah be pleased with her, who said: Allah's Messenger (SAW) said," Whoever dies with some fasting due on him, then, his heirs shall fast on his behalf" ( Sahih Bukhari 1952).
But if someone was sick in Ramadan until it ended and dies afterwards, it is not required of someone to fast on his behalf what he missed of Ramadan. In this case, the sick person who died, never lived to see those other days.
The evidence for this is in Surah Baqarah 184. "...And whoever is sick, or on a journey, then let him restitute in other days...."
